IRAC Releases February 2016 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2016 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through February 8, 2016.

Among other newly added cases, the Index now contains decisions:

• Holding that attempted battery with substantial bodily harm under Nev. Rev. Stat. 200.481 is not a crime of violence

• Granting a motion to reopen sua sponte based on the vacatur of a criminal conviction for a respondent who was removed in 2003

• Recognizing that the Department of Homeland Security may allow noncitizens who are subject to reinstatement of a prior removal order to instead seek asylum or other relief before an immigration judge

• Holding that a corporation’s conviction cannot be attributed to a shareholder and corporate officer who was never charged or convicted of a crime individually
