IRAC Releases June 2016 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2016 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through June 9, 2016.

Among other newly added cases, the Index now contains decisions:

• Faulting an immigration judge for denying a request for a continuance for a respondent seeking Special Immigrant Juvenile status who had already filed a dependency petition in the appropriate state court

• Rescinding an in absentia order against a respondent who was not informed of her hearing by a notario

• Holding that a statute of conviction referenced in a plea colloquy supersedes that referenced in an abstract of judgment

 

• Finding an attorney provided ineffective assistance of counsel by failing to submit an application required to seek cancellation of removal
