IRAC Releases March 2015 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2015 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through March 16, 2015.

Among other newly added cases, the Index now contains decisions holding:

• That possession of cocaine with intent to sell or deliver under Fla. Stat. 893.13(1)(a)(1) is not an aggravated felony

• That fourth degree assault under Kent. Rev. Stat. 508.030(1)(a) is not a crime involving moral turpitude

• That a respondent’s applications for relief should not be deemed abandoned where the DHS itself missed several filing deadlines

• That the potential availability of consular processing is not valid basis to deny a continuance pending the adjudication of a U visa application
