IRAC Releases May 2015 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2015 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through May 14, 2015.

Among other newly added cases, the Index now contains decisions holding:

• That respondents are not required to submit a completed application for relief with a motion to change venue

• That a respondent was not subject to INA 204(c) because the Board did not address a marriage fraud finding in an appeal of a prior visa revocation

• That a respondent violated his H-1B status by continuing to work part time as a clerk instead of as a store manager

• That an adverse credibility finding does not negate an immigration judge’s obligation to consider independently corroborating evidence

• That a pending state court dependency hearing constitutes good cause for a continuance
