IRAC Releases September 2015 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2015 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through September 11, 2015.

Among other newly added cases, the Index now contains decisions:

• Holding that theft under Ga. Code 16-8-2 is categorically not an aggravated felony

• Granting an untimely motion to reconsider sua sponte filed by a respondent outside the country in light of Mellouli v. Lynch, 135 S. Ct. 1980 (2015)

• Ordering further consideration of a motion to suppress because the immigration judge failed to determine whether the respondent’s allegations would warrant exclusion of the evidence

• Finding an immigration judge in York, Pa., violated regulations by failing to advise a pro se respondent of the availability of free legal service providers
