IRAC Releases May 2016 Update to Index of Unpublished BIA Decisions

The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2016 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through May 13, 2016.

Among other newly added cases, the Index now contains decisions:

• Terminating proceedings because DHS failed to show that the amount of restitution related to an offense involving fraud or deceit rather than a distinct theft-related charge

• Affording a respondent who simply forgot to submit biometrics another opportunity to comply with the biometrics instructions

• Recognizing “women who cannot leave a relationship” as a cognizable particular social group regardless of whether applicant was married to her abuser

• Criticizing an immigration judge for asking a non-party to proceedings about his immigration status
